India has specific laws to protect senior citizens from neglect, abuse, and property fraud. If you are above 60, or caring for an elderly parent, knowing these rights is essential.
The Maintenance and Welfare of Parents and Senior Citizens Act, 2007
This central law gives senior citizens the right to claim maintenance from their children or relatives. Key provisions:
- Children and grandchildren (including those who will inherit property) must maintain parents above 60 if the parents cannot maintain themselves
- A Maintenance Tribunal in each district can order up to Rs. 10,000 per month in maintenance (states can increase this)
- The order is passed quickly — the Tribunal must decide within 90 days
- Failure to comply is punishable with up to 3 months’ imprisonment
Reclaiming Property Gifted to Children
If a senior citizen transferred property to a child or relative on the condition that they would be maintained, and that person fails to provide maintenance, the transfer can be declared void. The Tribunal can set aside such transfers and restore the property to the senior citizen. This is a powerful protection against children who take property and then neglect parents.
Protection from Domestic Abuse
Senior citizens face elder abuse — physical, mental, and financial. The Domestic Violence Act, 2005 also protects senior citizens (not just women). An elderly person facing abuse by a family member can approach the Protection Officer or a Magistrate for a protection order.
FIR for Abandonment
Under Section 125 CrPC (now BNSS), abandoning a senior citizen without reasonable cause is a criminal offence. An FIR can be filed at the local police station.
Property Rights
Senior citizens are frequent targets of property fraud — forced signatures, forged documents, and coercion. If you have signed any document under pressure, you can challenge it in court. Courts give special consideration to the circumstances of elderly signatories when deciding undue influence cases.
