Domestic violence is a serious crime in India. If you or someone you know is experiencing abuse at home, there are strong legal protections available. You do not have to face it alone.
What Counts as Domestic Violence?
Under the Protection of Women from Domestic Violence Act, 2005 (PWDVA), domestic violence includes:
- Physical abuse — hitting, kicking, slapping, or any physical harm
- Emotional or verbal abuse — threats, insults, humiliation, controlling behaviour
- Sexual abuse — marital rape, forced sexual acts
- Economic abuse — withholding money, preventing employment, controlling finances
Who is Protected?
Any woman living in a domestic relationship — wife, live-in partner, mother, sister, or daughter — can seek protection under the PWDVA. The abuser does not have to be the husband; it can be any family member.
What Legal Remedies Are Available?
Protection Order
The court can prohibit the abuser from committing further violence, contacting you, or entering your home or workplace.
Residence Order
You have the right to continue living in the shared household even if you do not own it. The court can also direct the abuser to provide alternative accommodation.
Monetary Relief
You can claim compensation for medical expenses, loss of income, and damages caused by the violence.
Custody Orders
The court can grant you temporary custody of your children.
