Cyber Crime in India: How to File a Complaint and Get Legal Help

Cyber crimes — online fraud, identity theft, hacking, morphed images, and social media abuse — are rising rapidly in India. The law provides strong remedies, but acting fast is critical.

Common Cyber Crimes in India

  • Online financial fraud (UPI fraud, OTP fraud, loan app fraud)
  • Identity theft and impersonation
  • Hacking and unauthorised access
  • Morphed or intimate images shared without consent
  • Online stalking and harassment
  • Phishing and email fraud
  • Cyber bullying
  • Ransomware attacks on businesses

Laws That Apply

  • Information Technology Act, 2000 (amended 2008) – Sections 43, 66, 66C, 66D, 67, 67A, 67B cover unauthorised access, identity theft, fraud, and obscene content
  • Bharatiya Nyaya Sanhita (BNS), 2023 – cheating, extortion, defamation, and other offences committed online
  • IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 – platforms must remove illegal content within 36 hours of court/government order

Step 1 – Secure Evidence Immediately

Before anything else: take screenshots, save URLs, download transaction records, save chat logs. Digital evidence disappears quickly — social media posts get deleted, websites go down.

Step 2 – Report to the National Cyber Crime Reporting Portal

Go to cybercrime.gov.in — India’s centralised portal for reporting cyber crimes. Financial fraud and crimes against women/children get priority. After online reporting, you get an acknowledgment number.

Step 3 – File an FIR at the Cyber Crime Police Station

For serious matters, file an FIR at the nearest Cyber Crime Police Station or any police station. Financial frauds involving large amounts should be reported to both the portal and the police simultaneously. Mention your bank’s fraud helpline number (1930) for urgent freezing of funds.

Step 4 – Contact Your Bank Immediately

For UPI or banking fraud: call 1930 (National Cyber Crime Helpline) within the first hour. The faster the report, the higher the chance of freezing the fraudster’s account before they withdraw the money.

Getting Content Removed

For morphed images, defamatory posts, or intimate images shared without consent — send a complaint to the platform (Instagram, Facebook, YouTube) with the URL. Platforms must act within 24–36 hours for certain categories. If they fail, an advocate can obtain a court order directing removal.

Compensation for Cyber Crime Victims

Financial fraud victims can claim refunds through the banking system if the fraud is reported promptly. Courts have also awarded compensation from cyber criminals in civil suits. An advocate can help pursue both criminal and civil remedies simultaneously.
