Insurance Claim Rejected in India? Your Legal Options Explained

Insurance companies sometimes reject valid claims or delay payment without good reason. If your health, motor, life, or property insurance claim has been rejected or underpaid, you have several legal remedies available in India.

Common Reasons for Claim Rejection

  • Pre-existing condition not disclosed at the time of policy purchase
  • Claim filed after the limitation period
  • Alleged breach of policy conditions
  • Disputes over the cause of loss or damage
  • Fraud or misrepresentation allegations

Step 1 – Read the Rejection Letter Carefully

The rejection letter must give reasons. Review the policy terms and check whether the reasons cited are actually covered by a policy exclusion. Many rejections are based on incorrect interpretations of the policy.

Step 2 – Raise a Grievance with the Insurer

Every insurance company must have a Grievance Redressal Officer (GRO). File a written complaint. The insurer must respond within 15 days. If they do not, or if you are unsatisfied, escalate further.

Step 3 – Insurance Ombudsman

The Insurance Ombudsman is a free, fast, and informal dispute resolution mechanism. There are 17 Ombudsman offices across India. You can file a complaint if:

  • The claim is up to Rs. 50 lakhs (for life insurance) or Rs. 50 lakhs (for non-life)
  • The insurer rejected the claim or paid less than the claim amount
  • The insurer has not responded to your grievance for 30 days

The Ombudsman must pass an award within 3 months. Awards are binding on the insurance company if accepted by the claimant.

Step 4 – Consumer Forum (DCDRC / SCDRC / NCDRC)

Insurance is a “service” under the Consumer Protection Act, 2019. A deficiency in service (unjust rejection, delay, underpayment) can be challenged before the Consumer Forum. District forums handle claims up to Rs. 50 lakhs, State Commissions up to Rs. 2 crores, and the National Commission above that.

Step 5 – Civil Court

For very high-value claims or complex policy disputes, a civil suit in the appropriate court is an option.

IRDAI Bima Bharosa Portal

The Insurance Regulatory and Development Authority of India (IRDAI) has launched the Bima Bharosa portal (bimabharosa.irdai.gov.in) for registering insurance grievances. IRDAI can issue directions to insurers but cannot adjudicate individual disputes.
