Succession and Inheritance Law in India: Who Gets What After Death

When a person dies, their assets must be transferred to their legal heirs. The rules for who inherits what depend on religion, the existence of a will, and the type of property. Here is a clear overview.

With a Will (Testate Succession)

If the deceased left a valid will, the property is distributed according to the will’s instructions. The will must be executed properly — signed by the testator and witnessed by two people. For property, it should be registered.

Without a Will (Intestate Succession)

When there is no will, the applicable personal law determines who inherits:

  • Hindus, Sikhs, Buddhists, Jains — Hindu Succession Act, 1956 (daughters now have equal rights to ancestral property)
  • Muslims — Muslim Personal Law (Shariat) Application Act
  • Christians and Parsis — Indian Succession Act, 1925

Legal Heir Certificate vs Succession Certificate

A Legal Heir Certificate identifies who the legal heirs of the deceased are — used for government benefits and employment purposes. A Succession Certificate is issued by a court and allows heirs to collect debts and securities owed to the deceased.

Probate

For wills involving immovable property in certain states (Maharashtra, West Bengal, Tamil Nadu), probate — court validation of the will — is mandatory before assets can be transferred.

Daughters’ Rights in Ancestral Property

Following the Supreme Court’s landmark ruling in 2020, daughters have equal rights as sons in ancestral (Hindu joint family) property, regardless of when the father died.
